1. Introduction
Welcome to Kawaii Restorations. By using our black bar removal service, you agree to the following terms and conditions. Please read them carefully before proceeding with your request. If you do not agree to these terms, you must not use our services.
2. Service Description
Kawaii Restorations provides a service that removes black bars from artworks at the request of the client. This service is limited to digital artworks only. We do not create, distribute, or host any content. The modified images are returned exclusively to the client, and we do not store or share any submitted or modified content.
3. Client Responsibilities
Artwork Submission: By submitting an image for modification, you affirm that the image is a digital artwork and does not contain real-life photographs, videos, or any media depicting real individuals.
Age of Characters: You must not submit any artworks that depict characters who are, or appear to be, under the age of 18. Kawaii Restorations has a strict policy against modifying or working on any content that involves minors or characters that could reasonably be perceived as minors.
Ownership and Rights: You affirm that you are the legal owner of the artwork or have obtained all necessary rights, licenses, and permissions to modify the artwork. You are solely responsible for ensuring that your use of our service does not infringe on any third-party rights, including but not limited to copyright, trademark, and moral rights.
4. Service Limitations
Legal Compliance: Our service is offered only for legal purposes. We will not modify or work on any artworks that are illegal or that may violate copyright, trademark, or other intellectual property laws.
5. Intellectual Property
No Ownership Transfer: The use of our service does not transfer any intellectual property rights from the original creator or copyright holder to Kawaii Restorations or the client. The original copyright holder retains all rights unless explicitly agreed otherwise in writing.
Derivative Works: The modified artworks may be considered derivative works. By using our service, you acknowledge that the creation of derivative works may require the original copyright holder’s permission, and you agree to obtain such permission if required.
6. Liability
Client Liability: You agree to indemnify, defend, and hold harmless Kawaii Restorations, its affiliates, employees, and agents from any and all claims, damages, liabilities, costs, and expenses arising from your use of our service, including but not limited to any infringement of third-party rights or violations of law.
Limitation of Liability: Kawaii Restorations shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the use of our service, even if we have been advised of the possibility of such damages.
7. Confidentiality
Privacy: We respect your privacy and will not share your images or personal information with third parties without your consent, except as required by law.
Data Storage: We do not store any images after the completion of the service. All images are permanently deleted after the modified image has been returned to the client.
8. Prohibited Content
No Real Images: Clients must not submit any real-life photographs, videos, or any media depicting real individuals for modification. Our service is strictly limited to digital artworks.
No Minor Depictions: Clients must not submit any artworks depicting characters who are, or appear to be, under the age of 18. This includes any content that could reasonably be perceived as involving minors.
9. Refund Policy
No Refunds: Due to the nature of the service, all sales are final. We do not offer refunds once the service has been rendered.
10. Changes to Terms
We reserve the right to modify these terms and conditions at any time. Any changes will be effective immediately upon posting on our website. Your continued use of our service after any changes constitutes your acceptance of the new terms.
